Nev great place to have a shop. Buy in some goods...stick a price on them...sell them and them forget it. Now I know why when I look at warranty cards there is a different section for Australia.
As Luis says,,back to the shop for a refund then shoot the seller.

Hi all,
I couldn't resist commenting on the warrenty topic.
You buy what you buy not what you think you buy. Authorized dealers will sell you a train and a warranty. That warranty is non-transferrable. They added risk in handling such warranty returns is part of the price of the item to the dealer. So unauthorized dealers are selling second hand items and are thus not covered.
The other element I wanted to bring up is that the warranty kicks off when the comsumer buys the item from the authorized dealer. So if you buy from an authorized dealer a train that was made only in 2001, the warranty for that item begins when you buy it and if there is a problem Marklin are obligated to get resolution (fix, find equivalent, return purchase price or some other action). That can cause interesting issues for Marklin, so it is in their interests and the dealers interests to get everything sold as soon as possible and not have outstanding unsold stock. Though I imagine the tie up of capital are much stronger drivers for inducing stock turn over.
I had just such an issue. the item was sold by an authorized dealer in the US but this item hadn't been produced for several years. Unfortunatley, it had a problem so I sent it to Marklin USA with the receipt as proof of purchase from an authorized dealer and to establish the start of the warranty period. Marklin USA worked hard to fix it, but couldn't. they then looked around for a replacement and managed to find one (minor miracle itself), purchased it and then sent it to me all at no charge!
I bought an Ae8/14 from a private seller since I could not find any from a dealer. The decoder broke it is not Marklin's responsibility. Could they of built better decoders? Yes, but I knew the contract I was entering into.
No dealer no warranty you are choosing to take a risk at saving some money. But what about marklin's reputations? When you buy a "new" train from a non-dealer you are in effect gambling on the Marklin reputation for quality but there is no contractual warranty from Marklin.
In Arthur's case Brawa were doing this outside of the warranty contract. And a fine example it was too, fortunately for Arthur. Marklin could do the same and I would not be surprised if a newly produced model was serviced by them irrespective of the source. But to assume that is the case is not correct.
To paraphrase "Buyer be aware".

Probably this is true for all EU countries.
I can only speak for Germany. M*'s warranty is voluntary.
The dealer is required to provide 2 years of warranty, but
- private sellers may reduce this warranty to 0
- professional sellers may reduce this warranty to 12 months for second hand items
Therefore: ask your dealer first - don't send a loco to M* directly unless your dealer approved or suggested that.
But IANAL and I cannot say how much of this information applies to people who live outside Germany or outside the EU respectively (there shouldn't be many differences inside the EU (I hope)).
Regards
Tom

John. Interesting to note that you have a similar warranty to Australia in that the shop has no responsibilty. Here a shop is just that, whether they are dealers or not makes no difference ..if the loco is faulty you get your money back. Manufacturers have no contract with the customer.
Dealers are just shops which may sell only one manufacturers item or specialise in one type of goods but are no different from any shop Marklin sells its stuff to.
With a private seller there is of course no recourse.

Hmmm - I thought this was obvious and clear from the known mtc pin definitions. [;)

So, how about this one?

Hi Lutz,
A basic question:
The BR 85 (85-010) from starter set #29840 is not specified by article number (goes for all locs in starter sets), so how is it possible to find as an example part #113556 from that loc. if you don't have the belonging booklet with all the parts
It is not possible to search on set #29840.

Jepp Benny
Then you are correct, you'll need the manual / booklet to know the number.
Or you must wait until Märkln make a spare part list for the set 29840, if ever
Myself have tried to get spare part list of the model 37055 but no

Hi Benny,
just wait until it is set up in the spare parts db, similar to products like #29820, etc. (or even better - buy the set
).
PS: I've not (yet) started collecting and publishing the part numbers of instruction booklets for lately released models, but if you need one I might be able to find it out.
