The studs are solid parts of the rail. A rail is a rail no matter if it's a rail for train wheels or a power pickup.
Generally speaking Maerklin AC is based on the three rail concept in the "real" world.

The last word. It is acceptable to consider Märklin as a "3-rail system". End of discussion.
For those distressed that it has dragged on a bit, don't forget that we are two moderators down and the remainder are in scattered time-zones so response may not be a quick as some would like.
But, there is a (small) temptation in seeing how silly this thread could become. "There's nowt so queer as folk."
