While perusing the Marklin wallpaper picture for December I got to wondering (yes it has already been released) if having a Christmas tree of height such that it impedes the emmision of light from the third head lamp - does this violate railway regulations ?

I dunno.
If the scene shows 1960 or earlier, then the third headlight may not be required (introduced September 1, 1957 with a transition period of up to four years).

The scene looks like a loco standing in the station. IANAL but IMHO two headlights would be sufficient for shunting in the station.

Not all violations are penalised anyway ...
If you own such a loco, pretend the authorities have more important things to do and let the loco run as it is.

The wallpaper for January 2021 is already out ... lovers of Gt 2x4/4locos rejoice, with a picture of a model as issued in 2005 in K.W.St.B livery.

Yes, it does, all decorations on the locomotive must be securely fastened, waterproof and may NOT obscure the top headlight as it is a train signal.
It is also has to be checked at every stop.

Well, they do seem to be quoting a catalogue #39121 for a new version of the loco, if my German is reading correctly.

I think they have edited the text in the link, because it definitely mentioned it, which had me confused as to why they seemed to be mentioning a new item.

It seems the most recent release of the GT 2x4/4 in K.Bay.Sts.B. livery was 2013 "100 years anniv " model 37960, #5751.
If its coming again, I'll be very tempted. Very attractive model!

it's probably a typo. since the text refers to nostalgic models.

but since the BR 96 was released with a smoke generator, it's probable that they will also release it in K.W.St.B livery. Maybe 39962?
