Stephen,
are there any known issues why Märklin should follow. I really couldn't read what all the fuss was about, there are comments about rules and regulations within the EU. dismantling loco and selling them in parts is or has been an ongoing saga with Märklin locos on ebay, we also had a discussion about retailers selling parts of sets very cheaply or buying them in the hundreds from Märklin.
I may have missed the point again

Märklin already insists that UK retailers purchase their stock from a UK wholesaler (can't remember who it is, but they have been the LGB wholesaler for a long time) instead of purchasing direct from the factory, which was allowed for a handful of years up until Gaugemaster lost the franchise.
I believe a similar edict went out in the USA at about the same time, where dealers there are expected to deal with the franchise holder Walthers.
