There certainly is Ray, I shall upload them next.

Does any one know if there was a catalog for 2004/2005? If you look on Frits Osterthun's site, he has no cover for that year - the covers go from 2003/2004 straight to 2005.

David, after the 2003/4 catalog, the following year they produced the "Yearbook", which I believe was meant to show the models which had been produced in the previous year, rather than a catalogue which shows models which will be produced in the coming year. In this way they justified missing out a year.

They produced the Yearbook for 2005 and for 2006 and then went back to the "old way" for 2007/8 and 2008/9. So we are missing either 2004/5 or 2006/7, depending on how you look at it.

Thanks Ray, I thought that was the case, but wasn't 100% sure. That means that the 2002/2003 catalog I am currently scanning is the last one, that will complete the set from 1950 through to 2008/2009, at least for HO. There are some 1 Gauge and Z Gauge catalogs to scan as well. Plus one or two people want me to scan the Kolls 2002 - all 1500 pages or so!

In my opinion, copyright is an issue if someone is losing money from having their work copied.

So, for example, if you make and distribute copies of the current catalogue, which is still on sale from Marklin, then Marklin loses money because they are not selling the originals.

If you make copies of the 1975 catalogue, I don't think Marklin could argue that they are losing out, unless they are providing this service themselves for a fee, which they are not.

I'm not a lawyer, but I think my conscience would be clear if I behave according to these rules.

Although, essentially the catalogues are now given away free. Here in NZ we pay $30 odd for it, but this is the cost of having them freighted from Germany. The catalogue itself is free.

So you could argue that Marklin aren't losing money at all, in fact they may be benefiting by having them more widely distributed, in that (hopefully) more product is being sold.

I certainly wouldn't put something like the 07451 track plan book up for download, because that contains a specific copyright notice in it - you can't reproduce it by copying or scanning it. There doesn't seem to be any corresponding notice in any of the current catalogues.

In fact the last yearbook the copyright notice appears in is the 2003/2004 edition, which probably corresponds with the time when Marklin started giving the yearbook away for free (2005 edition).

And there are precedents set by Marklin themselves, where books such as the 0340 signal manual are freely available for download off various sites.

In Canada, copyright in an anyonymous literary work expires 50 years after the end of the calendar year in which it was first published (Copyright Act, s. 6.1). I believe that legislation in most other countries is similar. So there should be no copyright issue for the pre-1959 catalogues.

Unauthorized publication is an infringement, even if the publication is not undertaken for commercial purposes and even if the copyright holder is not currently publishing or profiting from the work. The copyright holder might not be able to prove any damages, but would in any case be entitled to an injunction to restrain the publication, and to costs.

That article is very interesting. Although it seems to relate more to either students or journalists, I suppose you could define our forum as a medium for evaluating and studying Marklin products. Copying a photo from a catalog or website and posting it for discussion purposes would seem to be covered as critical review, and therefore should be classed as "fair dealing" in most countries.

...but then, I'm an engineer, not a lawyer!

But I now see that in France, copyright in anonymous works subsists for 70 years from publication. (Code de la propriété intellectuelle, Art. L123-3) So I was not justified in assuming that the 50-year timespan is a general rule.

I agree. On the other hand, copying the entire catalogue probably would not be fair dealing.

I think this is all very sad, as I believe this to be a vital service in a forum like this. And for a company which relies heavyly on it´s heritage as Márklin does, it seems all the more strange that they don´t provide a similar service by themselves.
By the way David, I was looking forward to 1956-1971 especially 1960, which is my birthyear and 1967 which was the first catalog I ever saw, so if there is a way you can help me, I would be very happy.

Just out of interest . I have catalogues from the late 50's (56) through to the late 60's (69).. They did not have any layout diagrams in them .. I am assuming that somewhere in the 70's Marklin started including suggested layouts? ... (which then disappear prior to my next catalogues in the 90's when number one son arrived and hobby restarted)

Correct, there may be one or two track plans in some of the 1980's catalogs, but by that time those plans were based around the track extension sets available.

Very interested in those 70's catalogues then .. have large inventory of M track plus turntable, metal stations. bridges et al and am looking at how to best build a permanent (folding) layout

The Maerklin_Schienenanlagen_Spur_00.pdf file is from June 1938. On the first page bottom left there are some letters and numbers, YN 0638 j, and if i remember correctly "YN" refer to the number printed, "0638" to the month and year this booklet was printed in and then finally the "j" which is the the name of the printing house.

Hi Thor, you are correct. YN refers to 30,000 printed and "j" is the printing corporation.

Does anyone have scans of other 0 gauge catalogs from the 30s? I have the 1932 reprint and the 1935...looking for 37, 38, etc.

If you are looking for a particular model in one of those catalog years, I can help you out. I have a reference book with every O Gauge catalog from about 1890 - 1950s.
